Synopsis

A recent South Australian court decision caused a great amount of uncertainty and concern about the scope of a section of the Corporations Act which imposes personal liability on directors of corporate trustees in certain circumstances. Fortunately the Government has responded to lobbying from professional bodies and has introduced amendments to clarify the scope of trustee directors’ liability which should come into operation in the 2nd half of 2005. This article outlines the importance of this issue for investors and explains the solution proposed.
